Create a NEW U.S. legal action to empower non smokers against exposure to smoke?

Nonsmokers already have a right to sue under a general theory of tort if they can establish that the smoker's actions harmed their health. The difficulty is always establishing that it was THIS smoker who caused the health problem. You can do that in the case of SOME people who live together, but not for smokers generally.
